Company Policies.

MAI Transport Solutions’ company policies, effective 1 July 2022. All sub-contractors and personnel are required to read and adhere to these policies.

Drugs & Alcohol Policy

MAI Transport Solutions is committed to providing, maintaining and continuously improving health and safety standards across all operations. This commitment includes sustaining a healthy, drug and alcohol-free working environment for all sub-contractors and personnel who perform work on behalf of MAI Transport Solutions.

Alcohol and drug dependence are recognised as complex but treatable health conditions that can interfere with an individual’s wellbeing and work performance. MAI Transport Solutions regards dependence as a health matter and encourages any sub-contractor experiencing these challenges to seek professional treatment. Where practicable and appropriate, MAI Transport Solutions will aim to offer reasonable support.

1. Application of Policy

This policy applies to all sub-contractors of MAI Transport Solutions, including any person who enters company premises to perform work of any nature — regardless of the duration of that engagement. All persons are bound to observe and respect this policy in full.

Breaches of this policy may result in termination of the contract between MAI Transport Solutions and the sub-contractor. Sub-contractors must also refer to MAI Transport Solutions’ Occupational Health & Safety Policy, which applies in conjunction with this policy.

2. Definitions

“Company Premises” means all company buildings, offices, work locations, car parks, individual lockers and any other location where a sub-contractor is engaged in company business.

“Prohibited Drugs and Substances” means any drug or substance prohibited by State or Commonwealth legislation (including regulations), or any substance (other than as prescribed for medical purposes) that has the effect of intoxicating or altering the behaviour of a person — including but not limited to Alcohol, Cannabis, Opiate analgesics, Stimulants, Amphetamines, Cocaine, Hallucinogens and Designer drugs.

“Defined Alcohol Limit” means the legislated blood alcohol content (BAC) limit applicable to persons in charge of vehicles.

3. Principles: Drugs, Alcohol & Smoking

The use of alcohol or drugs directly affects a sub-contractor’s ability to perform safely. Sub-contractors must not be under the influence of drugs or exceed the legislated BAC at any point during working hours — particularly when operating mobile equipment or machinery including cranes, forklifts, trucks or any other vehicle.

Smoking is not permitted in any mandatory non-smoking area maintained by MAI Transport Solutions. Non-smoking areas include:

• All areas presenting an occupational health and safety hazard

• Areas containing sensitive equipment, computer systems or records

• All areas marked with “No Smoking” signage

• Confined access areas such as lifts, stairwells and toilets

• Food preparation and storage areas

• Areas where combustible fumes may collect, including garages, loading zones and chemical storage

• All interior spaces

• Any exterior area where another person requests smoking cease

MAI Transport Solutions reserves the right to extend non-smoking areas or impose a total ban at any time.

4. Education & Implementation

It is the responsibility of all managers and supervisors to comply with and actively implement this policy. MAI Transport Solutions will ensure all sub-contractors remain aware of this policy on an ongoing basis.

Sub-contractors are expected to:

• Report any drug or alcohol concern in writing before it reaches a level that affects safe and efficient work performance

• Seek appropriate medical or community assistance

• Agree to accept professional help where offered

All assistance provided by MAI Transport Solutions will be assessed on a case-by-case basis and handled with strict confidentiality.

5. Breach of Policy

Sub-contractors are accountable for their own conduct and performance. Any behaviour that poses a risk of harm to themselves, colleagues or any other person on company premises — including contravention of this policy — may result in immediate termination of the sub-contractor’s contract with MAI Transport Solutions.

6. Guidelines for Alcohol Consumption

Alcohol may only be served or consumed on MAI Transport Solutions premises with the specific approval of a member of Management. Any approved function must be conducted in a hazard-free area, with responsible service practices in place. Non-alcoholic and low-alcohol alternatives must be made available at all such events.

7. Sub-contractors Authorised to Drive

Under no circumstances shall any sub-contractor operate a vehicle whilst under the influence of any drug or alcohol, or where the BAC exceeds the limit prescribed by law. Any breach of this provision will void any indemnity granted by insurers and render the driver personally liable for any resulting damage or loss.

8. Acknowledgement

MAI Transport Solutions is committed to ensuring every sub-contractor reads and understands this policy. If any aspect of this policy is unclear, sub-contractors are urged to contact Management immediately.

This policy and its contents are binding on the sub-contractor. A breach may result in termination of the contract. By continuing to perform work for MAI Transport Solutions, sub-contractors acknowledge that they have read and agree to be bound by this policy for the life of their engagement.
